Welcome to TheMarket Robo. These Customer Terms of Service ("Customer Terms") govern your use of the TheMarket Robo platform as a customer with TMKR Global, LLC ("Company," "we," "us," or "our"). As a customer, you can browse, purchase, and use digital trading tools offered on our marketplace.

These Customer Terms are in addition to our general Terms of Service. By registering as a customer, you agree to be bound by both these Customer Terms and the general Terms of Service.

2. Acceptance of Terms

By creating a customer account, browsing our marketplace, or making any purchase through our platform, you acknowledge that you have read, understood, and agree to be bound by these Customer Terms.

3.1 Account Registration

You must register for a customer account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

3.2 Account Security

You must take reasonable measures to protect your account credentials. You must not share your account with others or allow unauthorized access. You must notify us immediately of any unauthorized use or security breach.

3.3 Account Information

You must keep your account information current and accurate, including your email address and payment details. Failure to maintain accurate information may result in inability to access purchased products or account suspension.

4. Platform Usage

4.1 Permitted Use

You may use our platform to browse digital trading tools, read product descriptions and reviews, purchase products, manage your licenses, and access customer support. All use must comply with these terms and applicable laws.

4.2 Platform Availability

We strive to keep the platform available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from platform downtime.

4.3 Content Accuracy

While we endeavor to provide accurate information, product descriptions are provided by vendors and we do not guarantee their accuracy. Performance data, backtests, and review content are for informational purposes only and should not be relied upon as financial advice.

5. Digital Products and Services

Product Information

Our platform offers algorithmic trading robots, expert advisors, trading indicators, and related digital tools created by third-party vendors. We act as a marketplace facilitating transactions between vendors and customers.

5.1 Product Licensing

When you purchase a product, you receive a limited, non-exclusive, non-transferable license to use it. You do not obtain ownership of the underlying code or intellectual property. License terms, duration, and device limitations are specified in each product listing.

5.2 Product Support

Product support is primarily provided by the vendor who created the product. We facilitate communication between customers and vendors but are not responsible for the quality or timeliness of vendor support.

5.3 Product Updates

Product updates may be provided by vendors at their discretion. We do not guarantee that products will be updated or that updates will be compatible with your trading platform or system.

6. Payment and Billing

6.1 Payment Processing

Payments are processed through our chosen payment provider. By making a purchase, you agree to the payment terms presented at checkout. We are not liable for payment processing errors or issues arising from the payment provider's services.

6.2 Pricing

All prices are displayed in the currency specified on our website. Prices are set by vendors and may change without notice. Applicable taxes are calculated at checkout based on your location and applicable tax laws.

6.3 Refunds and Cancellations

The full Refund and Cancellation Policy is set out in our User Agreements (Section 6 — Refunds and Cancellations) (/user-agreements#no-refunds). Refunds are not offered for change of mind or trading losses. Refunds or subscription credits may be issued only in the strict event of non-delivery of the digital product or a material technical failure of the software or delivery mechanism that our support team cannot resolve within a reasonable time after you cooperate with troubleshooting. You may cancel your recurring subscription at any time through your user dashboard; cancellation stops future billing and access continues until the end of the current billing cycle. Please contact support before initiating any payment dispute.

**THE PLATFORM AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" BASIS.** We make no warranties regarding product performance, trading outcomes, or platform availability. Trading in financial markets involves substantial risk of loss.

We are not responsible for any trading losses, financial damages, or other consequences arising from your use of purchased products. You acknowledge that trading is inherently risky and that past performance does not guarantee future results.

You agree to indemnify and hold harmless TMKR Global, LLC from any claims, damages, or losses arising from your use of our platform or products, including trading losses, regulatory violations, or third-party claims.

9.1 Refund Policy

Digital licenses are generally **not refundable** for change of mind. Refunds may be considered only for **non-delivery** or a **material** failure we cannot fix in a reasonable time, as described in Section 6.3. The full contract terms are in our User Agreements (Section 6 — Refunds and Cancellations).

10. Account Suspension and Termination

10.1 Suspension

We may suspend your customer account at any time if we suspect violations of these Terms, fraudulent activity, or prohibited practices. During suspension, access to purchased products may be restricted pending investigation.

10.2 Termination

Either party may terminate the customer relationship. You may close your account at any time by contacting support. We may terminate your account for material breach of these terms. Upon termination, access to purchased products may be revoked, and no refunds will be provided.

11. Modifications to Terms

We reserve the right to modify these Customer Terms at any time. Material changes will be communicated via email or through our platform with at least 30 days' notice. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Customer Terms shall be governed by the laws of Georgia. Any disputes shall be resolved through binding arbitration in Tbilisi, Georgia, unless otherwise required by applicable consumer protection laws in your jurisdiction.
